What's it like to be a Conveyancer?
Conveyancing is the legal process of transferring the title of a property from one party to another. In commonwealth systems, Conveyancers are licensed individuals that specialise in providing legal services for clients buying and selling property. In Malaysia, practising Conveyance Law requires being a member of the Malaysian Bar. However, a Conveyancer’s sole focus is on the laws bound within the service of conveyancing.
Tasks and duties
- Overseeing transactions in real estate.
- Ensuring that all transactions meet their legal obligations.
- Filing and registering all legal paperwork for property transfer.
- Attending meetings with legal parties involved in transactions.
- Ensuring that rights of both buyer and seller are protected during the transaction.
Conveyancers have a strong understanding of real estate law. This knowledge helps when dealing with land owners, estate agents, solicitors, lawyers, and other legal parties during real estate transactions. Conveyancers can find jobs in law firms that offer and specialise in conveyance law or in real estate companies that require legal expertise when conducting real estate transactions.
How to become a Conveyancer
Starting a career as a Conveyancer requires familiarity with real estate law. In Malaysia, this requires having a licence to practise law. There are numerous legal procedures to go through to ensure that real estate transactions go smoothly and all legal obligations from both parties are met.
- Complete a pre-university course. For students, there are several courses recognised by the Legal Profession Qualifying Board of Malaysia (LQPB). These are A-Level, Malaysian Higher School Certificate (STPM), International Baccalaureate Diploma Programme (IBDP), Foundation, Matrikulasi, or Diploma.
- Finish a law degree recognised by the LQPB. This usually takes three to four years.
- Get a Certificate of Legal Practice. This certificate can be acquired by taking the exam conducted by the LQPB.
- Take up your pupillage. This is an internship and is also commonly known as chambering. Pupils get to shadow a senior counsel for a nine-month period. Additionally, they must also take an Ethics and Professional Standards course and provide 14 days of legal aid.
- Get admitted to the Malaysian Bar exam. This requires passing the requirements to become a licensed legal practitioner in Malaysia. From here, specialisation in Conveyance Law can be considered.
- Experienced conveyancers can expand their practice by opening their own real estate law firm or becoming an authority in Conveyance Law by being on top of current amendments.
